Subject: Mazi Nnamdi Kanu tries to prevent further abuses of his constitutional rights.
Mazi Nnamdi Kanu’s legal team filed two distinct court cases two days ago, attempting to compel the authorities to follow the black letters of the Constitution and relevant statutes in the overall handling of Mazi Nnamdi Kanu’s case.
In the first suit, Number: CV/875/25, filed before the High Court of the Federal Capital Territory, we demanded that Mazi Nnamdi Kanu’s constitutional right to a fair hearing and a trial within a reasonable time be enforced or that he be released unconditionally.
In the second suit, Number: M/3224/2025, which was also filed in the High Court of the Federal Capital Territory, we seek a Mandamus to compel the authorities to follow the law in the conduct of his trial, including the transfer of his case to Southeast, where it should have been instituted in the first place.
We would like to make it abundantly apparent that these suits were prompted principally by the numerous illegal and unlawful practices that have infected the conduct of Mazi Nnamdi Kanu’s case since Honorable Justice Binta Murtala-Nyako’s recusal on September 24, 2024.
In summary, the unconstitutional and unlawful actions include the refusal to reassign the case to another judge, the backward reassignment of the case to the same judge who recused herself from the case, the refusal to consider transferring the case to Southeast, and, most importantly, the authorities’ failure to bring the case to a proper trial within a “reasonable time” as required by the Constitution.
To be clear, the authorities’ conduct represents a major miscarriage of justice that has resulted in significant harm to Mazi Nnamdi Kanu’s legal rights, particularly the grave unfairness of keeping him in jail for nearly four years without a fair trial. Mazi Nnamdi Kanu, as a human being with certain intrinsic rights, cannot sit idly by while these atrocities continue.
